{"id":342,"date":"2025-06-20T11:53:29","date_gmt":"2025-06-20T02:53:29","guid":{"rendered":"https:\/\/ogpat.com\/tm\/?page_id=342"},"modified":"2025-07-04T15:52:12","modified_gmt":"2025-07-04T06:52:12","slug":"halloumi-is-rejected-as-a-descriptive-mark","status":"publish","type":"page","link":"https:\/\/ogpat.com\/tm\/news\/halloumi-is-rejected-as-a-descriptive-mark\/","title":{"rendered":"\u201cHALLOUMI\u201d is rejected as a descriptive mark"},"content":{"rendered":"\n<p class=\"wp-block-paragraph\">Appeal No. 2022-6716 (12\/9\/2024)<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Applicant: Foundation for the Protection of the Traditional Cheese of Cyprus named Halloumi<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Summary:<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The applicant filed a collective trademark application for \u201cHALLOUMI\u201d in terms of \u201ccheese\u201d in Class 29.&nbsp; The application was rejected based on Article 3 (1) (iii) and 4 (1) (xiv) of the Trademark Act and the applicant filed an appeal to the decision of refusal.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The board of appeal held that the mark \u201cHALLOUMI\u201d lacks distinctiveness in terms of \u201ccheese\u201d and decided that the appeal of the case was groundless.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">\u201cHALLOUMI\u201d is known as a semi-hard, unripened salted cheese originating from Cyprus and made from a mixture of goat\u2019s milk, sheep\u2019s milk and cow\u2019s milk produced in Cyprus and its surrounding area.&nbsp; Based on the facts, the board of appeal held that traders and consumers would recognize the mark as an indication of the products, if the mark is used for Halloumi.&nbsp; Also, if the mark is used in terms of cheese other than Halloumi, consumers may be confused as to the quality of goods.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The applicant argued that the mark has been used for the goods made by the members of the Foundation and the applicant uses the mark exclusively in commerce.\u00a0 However, the board of appeal die not accept the argument, because the submitted evidence of use of the mark is not sufficient to demonstrate exclusive use of the mark for a long time.<\/p>\n","protected":false},"excerpt":{"rendered":"<p>Appeal No. 2022-6716 (12\/9\/2024) Applicant: Foundation for the Protection of the Traditional Cheese of Cyprus  [&hellip;]<\/p>\n","protected":false},"author":2,"featured_media":0,"parent":106,"menu_order":0,"comment_status":"closed","ping_status":"closed","template":"","meta":{"_lightning_design_setting":{"layout":"default"},"footnotes":""},"class_list":["post-342","page","type-page","status-publish","hentry"],"_links":{"self":[{"href":"https:\/\/ogpat.com\/tm\/wp-json\/wp\/v2\/pages\/342","targetHints":{"allow":["GET"]}}],"collection":[{"href":"https:\/\/ogpat.com\/tm\/wp-json\/wp\/v2\/pages"}],"about":[{"href":"https:\/\/ogpat.com\/tm\/wp-json\/wp\/v2\/types\/page"}],"author":[{"embeddable":true,"href":"https:\/\/ogpat.com\/tm\/wp-json\/wp\/v2\/users\/2"}],"replies":[{"embeddable":true,"href":"https:\/\/ogpat.com\/tm\/wp-json\/wp\/v2\/comments?post=342"}],"version-history":[{"count":2,"href":"https:\/\/ogpat.com\/tm\/wp-json\/wp\/v2\/pages\/342\/revisions"}],"predecessor-version":[{"id":352,"href":"https:\/\/ogpat.com\/tm\/wp-json\/wp\/v2\/pages\/342\/revisions\/352"}],"up":[{"embeddable":true,"href":"https:\/\/ogpat.com\/tm\/wp-json\/wp\/v2\/pages\/106"}],"wp:attachment":[{"href":"https:\/\/ogpat.com\/tm\/wp-json\/wp\/v2\/media?parent=342"}],"curies":[{"name":"wp","href":"https:\/\/api.w.org\/{rel}","templated":true}]}}
